BANKRUPTCY INSTEAD OF CREDIT REPAIR? IT’S USUALLY NOT THE BEST CHOICE. HERE’S A STORY WITH A TWIST.
Some people are under the impression they should wait until the negative information has been deleted from their credit report before applying for new credit. The unfortunate part of that line of thinking is that things like collections, repossessions, and bankruptcies don’t quickly fall off your credit report. Generally, it can take from 3-5 years for these items to clear from your credit reports.
I recently spoke to a client who had a terrible credit rating on all his reports. He could not get credit for his business at a reasonable rate (say under 12%). The banks were offering 13%- 19% rates!
What was all the more frustrating was that the collections and late pays were on accounts that he never opened! That’s right. Some else was using his good name to open up credit and then bail out on the payments.
He had jewelry stores, cellular service, satellite services, apartment RENTAL, utilities…you name it. All had been opened by someone stealing his identity.
This poor fellow had tried disputing these items, put fraud alerts out on the 3 credit bureaus and even wrote letters to the FTC. He couldn’t get this cleared up and worse…there was evidence of more current illegal activity on his credit reports.
He finally broke down and hired a credit attorney to file bankruptcy. That’s right. He was going to file bankruptcy to clear up his credit on accounts that weren’t even his! Well to make a long story short the bankruptcy didn’t go through because the law states you can’t file bankruptcy on someone else’s debts…Catch 22.
I met him when after he called wanting to know if I could help him with credit repair. We talked through some options … like getting him into a decent identity theft program as well as credit repair. The good news is that the identity theft program is stopping new fraudulent activity on his financial identity.
The not so good news is that we have been working 7 months on the clean up and are only 50% through it. It takes work and time. Also, there are times the credit bureaus refuse to correct items even after providing proof that they are incorrect. That’s when a little assist from an attorney helps move things along.
